These Terms of Use govern your use of the website operated by The Ohana Vault LLC (the “Company,” “we,” or “us”). By using this site you agree to these terms. If you do not agree, do not use the site. Services purchased from us are governed by the Customer Agreement, not by these Terms of Use.


  1. What This Site Is. This site describes the Company’s digitization and photo restoration services and allows you to submit an inquiry. It is informational and does not itself provide the services.

  2. Inquiries Are Not Orders. Submitting an inquiry, requesting a quote, or receiving an estimate does not create a contract and does not obligate the Company to perform any work. Services are provided only under a separate written Client Service Agreement and a written order confirmation. Prices, availability, and turnaround times described on this site are estimates and may change.

  3. Do Not Send Originals Through This Site. Do not mail or deliver physical materials to the Company before you have received an order confirmation. Do not submit sensitive personal information, such as identification numbers or financial account numbers, through the inquiry form.

  4. .Sample Images You Submit. If you upload or email sample images so we can prepare a quote, you represent that you have the right to do so. You grant the Company a limited license to view, store, and reproduce those images solely for the purpose of evaluating your inquiry and preparing a quote. We will not use them for any other purpose, and we delete them if you do not proceed with an order.

  5. Site Content. All text, images, layout, logos, and other content on this site are owned by the Company or used with permission and may not be copied, reproduced, or used without written permission, other than ordinary personal viewing.

  6. Acceptable Use. You may not use this site to transmit unlawful, infringing, or harmful content, to attempt to gain unauthorized access to the site or its systems, or to interfere with its operation.

  7. Third-Party Services. This site is hosted on a third-party platform and may use third-party services for forms, scheduling, analytics, and payment processing. Your use of those services is also subject to their own terms and privacy policies. The Company is not responsible for third-party services or for the content of any site linked from this one.

  8. Disclaimer. This site is provided on an “as is” and “as available” basis. The Company does not warrant that the site will be uninterrupted, error-free, or free of harmful components, and disclaims all implied warranties to the maximum extent permitted by law. Information on the site is general and is not professional advice regarding the preservation of your materials.

  9.  Limitation of Liability. To the maximum extent permitted by Florida law, the Company is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of this site. This section governs use of the site only. Liability relating to services performed on your materials is governed by the Client Service Agreement.

  10. Changes. The Company may update these Terms of Use at any time by posting a revised version with a new date. Continued use of the site after posting constitutes acceptance.

  11. Governing Law. These Terms of Use are governed by the laws of the State of Florida, and any action shall be brought exclusively in a court of competent jurisdiction in Pinellas County, Florida.

PRIVACY POLICY

THE OHANA VAULT LLC


The Ohana Vault LLC handles irreplaceable family materials, and we treat the information that comes with them accordingly. This policy explains what we collect, how we use it, and what choices you have.

  1. Information We Collect. We collect the contact information and project details you provide through our inquiry form, by email, or by phone, including your name, address, phone number, email address, and a description of your materials. We collect any sample images you send us. We collect records of the services we perform for you and the digital files we create. Payment card details are collected and processed by our payment processor and are not stored by us.

  2. Information Collected Automatically. Our website host and analytics tools may collect standard technical data such as IP address, browser type, pages visited, and referring site. This information is used to operate and improve the site.

  3.  How We Use Information. We use your information to respond to inquiries, prepare quotes, perform and deliver the services, communicate with you about your order, process payments, keep business and tax records, and comply with law. With your separate opt-in consent, we may use digitized reproductions of your materials for promotion as described in our Client Service Agreement.

  4. We Do Not Sell Your Information. We do not sell, rent, or trade your personal information or your materials. We do not share your materials with anyone outside the Company for marketing purposes without your express written consent.

  5. Service Providers. We share limited information with service providers who help us operate, such as our website host, payment processor, email provider, and shipping carriers. They receive only what they need and are expected to protect it. We may also disclose information where required by law or legal process.

  6. Your Materials and Digital Files. Your physical materials are handled only by Company personnel. Your digital files are stored on access-controlled systems. We retain a copy of completed files for ninety (90) days after delivery and then permanently delete them, unless you have asked us in writing to keep them longer. We are not a backup or archival service.

  7.  Security. We use reasonable, industry-standard administrative and technical safeguards to protect information in our possession. No method of storage or transmission is completely secure, and we cannot guarantee absolute security.

  8. Materials Depicting Children. Many of the materials we handle include images of children. We do not use any image depicting an identifiable child for promotion without the specific, written, opt-in consent of that child’s parent or legal guardian. Our website and services are directed to adults, and we do not knowingly collect personal information directly from children.

  9. Your Choices. You may request a copy of the personal information we hold about you, ask us to correct it, ask us to delete it, or withdraw promotional consent at any time by contacting us at the address below. We will respond within a reasonable time. Some information must be retained for tax, accounting, or legal purposes.

  10. Marketing Email. If you receive marketing emails from us, you can unsubscribe using the link in any message or by contacting us. We will continue to send transactional messages about your active orders.

  11. Changes. We may update this policy by posting a revised version with a new date. If we make a material change in how we handle your materials, we will notify active customers by email.
